MEMORAUTO
Terms of use
Terms applicable to access to and use of MEMORAUTO.
These terms govern use of the public pages and the MEMORAUTO platform. By creating an account or using a private area, the user accepts the applicable version of these terms.
MEMORAUTO is the trading name of the platform owned by icheck management services sl, Tax ID B16538316, registered at Calle del Ter 27, first floor, left, 07009 Palma de Mallorca, Spain. Contact: memorauto@memorauto.com.
1. Purpose and users
MEMORAUTO connects drivers, workshops and companies around the vehicle. It offers digital history, documents, authorisations, maintenance, repairs, communications, fleet coordination, billing and integrations according to the enabled role and plan.
2. Capacity and representation
Users must have sufficient legal capacity. Anyone acting for a workshop, company or other organisation represents that they are authorised to bind it, manage its members and accept applicable terms on its behalf.
3. Registration, activation and credentials
- Drivers may register for functions available to their profile.
- Workshop or company access may require review, verification, invitation or activation and is not automatic.
- Registration details must be true, current and complete.
- Credentials are personal; users must protect them and report unauthorised access.
4. Roles, permissions and authorisations
Access depends on the current role, organisation, vehicle and authorisations. The authorised owner or administrator must review members and permissions. Accessing records, images, documents, costs or third-party data outside the authorised scope is prohibited.
5. Obligations and prohibited uses
- Use the service lawfully, in good faith and in accordance with these terms and operational instructions.
- Do not impersonate others or provide data, images or documents without a lawful basis.
- Do not submit unlawful, false, offensive or malicious content or content that infringes third-party rights.
- Do not engage in spam, fraud, bulk extraction, improper reverse engineering, attacks, overload or circumvention of controls.
- Keep information current where an inaccuracy could affect another person or organisation.
6. Content and vehicle history
A contributor retains any applicable rights and grants MEMORAUTO permission necessary to store and process the content, display it to authorised users and provide the service. Each contributor is responsible for the lawfulness and accuracy of their data. The platform provides traceability but does not independently validate that mechanical work was properly performed.
7. Professional responsibility
Diagnoses, quotes, repairs, inspections, maintenance decisions and tax obligations remain the responsibility of the professional or organisation performing them. MEMORAUTO does not replace their judgement, information duties, warranties or responsibility to the customer.
8. Artificial intelligence assisted functions
Assisted reading or generation functions produce suggestions and may be wrong or omit information. Users must review outputs before saving or using them and must never treat them as a mechanical diagnosis, legal advice or a final automated decision.
9. Sealing and verification
Sealing records a cryptographic fingerprint to check whether sealed content has changed. It does not prove the original truth, quality of work or identity of the actor beyond controls available on the platform. A blockchain transaction may be public and technically irreversible.
10. Plans, prices and payments
Functions may depend on a plan, trial, courtesy period, add-on or commercial agreement. Applicable pricing, tax and frequency will be disclosed before a charge. Non-payment, expiry or the end of an entitlement may restrict functions without deleting obligations or records that must be retained.
11. Availability and development
The service may change, introduce limits or be interrupted temporarily for maintenance, security, incidents, technical development, external providers or force majeure. Beta, pilot or gradually activated functions may not be available to every profile or plan.
12. Intellectual property
The MEMORAUTO brand, software, structure, design and proprietary content are protected. Users receive only a limited, revocable, non-exclusive and non-transferable right to use the service during their legitimate relationship with the platform.
13. Suspension and termination
MEMORAUTO may restrict or suspend access due to security risk, breach, abuse, lack of authorisation, non-payment or a legal requirement. Where possible, the reason and remediation route will be disclosed. Termination does not prevent blocked data or records from being retained for legal obligations, integrity or defence.
14. Liability
Each party is responsible for its own acts and obligations. To the extent permitted by law, MEMORAUTO is not liable for false third-party data, external professional decisions, unauthorised credential use, unavoidable unavailability or third-party services. Nothing in these terms excludes non-excludable liability or mandatory consumer rights.
15. Changes to these terms
MEMORAUTO may update these terms for legal, technical, functional or commercial changes. The current version and date will be published here; material changes will be communicated where required. Continued use after the effective date constitutes acceptance, without prejudice to any applicable termination rights.
16. Governing law and disputes
Spanish and European Union law applies. Disputes will be heard by the bodies with statutory jurisdiction. Users acting as consumers retain the venue and mandatory rights granted by consumer law.
